PH antimonopoly body probes flood control bid-rigging; firms face fines up to P275M each

Firms found to be colluding on flood control bids could each face fines of up to P275 million under the Philippine Competition Act, the country’s antitrust regulator warned.

The Philippine Competition Commission confirmed it is investigating the Discaya-led St. Timothy Construction, Wawao Builders, IM Construction, SYMS Construction, and Sunwest, along with officials from DPWH Bulacan and Region IV-B. 

The inquiry stems from Department of Public Works and Highways referrals and inspection reports, as well as testimonies presented in recent congressional hearings. 

Investigators are now reviewing bid documents and possible communications to establish whether anti-competitive agreements took place. 

"The PCC reminds the public that individuals or entities involved in cartel conduct, such as bid-rigging, price fixing, market allocation, or output restriction, may avail of the Commission’s Leniency Program," the government watchdog said in a statement. 

"The program offers immunity from suit or a reduction of administrative fines to those who voluntarily disclose their participation in anti-competitive agreements and cooperate fully with the PCC’s investigation," it added.
